Früheres Abfallende nach dem Koalitionsvertrag und bereits nach § 5 KrWG

Der Koalitionsvertrag will das Ende der Abfalleigenschaft vorziehen. Dabei wurde das Recycling schon durch das KrWG 2020 stark aufgewertet. Hintergrund ist die durch die Novelle der Abfallrahmenrichtlinie (AbfRRL) angestrebte anspruchsvolle Verwertung, welche durch den EU-Aktionsplan Kreislaufwirtschaft vom März 2020 zusätzlich unterlegt und verstärkt wurde. Deshalb ist die Abfalleigenschaft nach § 5 KrWG möglichst früh anzusetzen, um Absatzmöglichkeiten zu stärken, sofern Mensch und Umwelt geschützt bleiben. So sind auch innovative Einsatzmöglichkeiten besser zu fördern, um neue Stoffkreisläufe zu etablieren und Primärrohstoffe einzusparen – entsprechend der Zielsetzung des Green Deal wie auch des Koalitionsvertrages. § 5 KrWG lässt sich zwar schon in diese Richtung interpretieren. Eine klarere und offenere Formulierung von § 5 Abs. 1 Nr. 1, 2 und auch 3 KrWG würde aber der Praxis erheblich helfen, auch innovative und neue Lösungen am Markt zu platzieren.

The coalition agreement wants to bring forward the end of waste status. Recycling has already been strongly upgraded by the Kreislaufwirtschaftsgesetz (KrWG – Circular Economy Act) 2020. The background to this is the ambitious recycling targeted by the amendment to the Waste Directive, which was additionally underpinned and strengthened by the EU Action Plan for the Circular Economy of March 2020. Therefore, the waste status according to Section 5 KrWG should be set as early as possible in order to strengthen sales opportunities, provided that people and the environment remain protected. Innovative uses should also be better promoted in order to establish new material cycles and save primary raw materials – in line with the objectives of the Green Deal and the coalition agreement. Section 5 of the KrWG can already be interpreted in this direction. However, a clearer and more open formulation of Section 5 (1) No. 1, 2 and also 3 KrWG would considerably help the practice to also place innovative and new solutions on the market. marktung von Recyclingprodukten stärken.
